1. Agreement to Terms

By accessing and using the Zirske LLC ("Company," "we," "us," "our") vehicle rental service and website (bookzirske.com), you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions set forth in this Terms of Service Agreement.

2. Vehicle Rental Agreement

By renting a vehicle from Zirske LLC, you agree to:

• Provide accurate and complete information during the rental process.
• Be at least 21 years of age with a valid driver's license.
• Present a valid credit card for the rental transaction.
• Use the vehicle solely for lawful purposes and in accordance with all applicable laws.
• Return the vehicle in the same condition as received (normal wear and tear excepted).
• Pay all rental fees, fuel charges, and any applicable damages or violations.
• Be responsible for traffic violations, parking tickets, and tolls incurred during the rental period.

3. Insurance and Liability

You are responsible for maintaining adequate insurance coverage on the rented vehicle. You agree to indemnify and hold harmless Zirske LLC from any claims, damages, or losses arising from your use of the vehicle. Zirske LLC is not liable for personal belongings left in the vehicle.

4. Damage and Charges

You agree to pay for any damage to the vehicle that occurs during your rental period, including but not limited to:

• Collision damage
• Damage from improper maintenance or neglect
• Excessive fuel consumption
• Cleaning charges for excessive dirt or damage to interior
• Mechanical damage caused by misuse

5. Mileage and Fuel

You agree to return the vehicle with the fuel level matching that at the time of rental. Excessive mileage beyond the agreed rental period will be charged at the applicable rate. You are responsible for all fuel costs incurred during the rental.

6. Late Returns

Late returns will be charged at the standard daily rental rate for each day or partial day the vehicle is not returned. Grace periods do not apply. Vehicles not returned within 24 hours of the rental end time may be reported as stolen.

7. Prohibited Use

You agree not to:

• Use the vehicle for commercial purposes without written consent.
• Allow unauthorized drivers to operate the vehicle.
• Smoke, use drugs, or engage in illegal activities in the vehicle.
• Transport illegal substances or weapons.
• Exceed vehicle weight limits.
• Drive under the influence of alcohol or drugs.

8. Cancellation and Refund Policy

Cancellations must be made at least 24 hours prior to the rental start time for a full refund. Cancellations within 24 hours will be subject to a cancellation fee. No-shows forfeit the full rental amount.

9. SMS Communication Disclosure

SMS and Communications

Carriers are not liable for delayed or undelivered messages. You must be 18 years or older to use this service or receive SMS communications from Zirske LLC.

10. Limitation of Liability

To the fullest extent permitted by law, Zirske LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the rental service or website.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Ector County, Texas.

12. Changes to Terms

Zirske LLC reserves the right to modify these Terms of Service at any time. Your continued use of the rental service constitutes acceptance of any changes.
